A trademark identifies a product as belonging to a specific company and recognizes a company’s ownership of the brand. Individuals and companies choose to have their products or services trademarked to protect the product from being used without their permission, and permission for use of a registered mark comes with a price. Furthermore, the penalties for using a registered mark without permission can be steep. If your business has a unique name or distinctive logo it is important to consider obtaining a registered mark from the United States Patent and Trademark Office (USPTO).
Our firm has created a 10-step approach to trademarking that allows clients to have more control over costs associated with trademark filings and a better understanding of the timeling of the trademark filing process. We also strongly encourage our clients to take advantage of the resources they receive once engaged as a trademarking client (10-step to trademarking handout and detailed power point on important information related to the trademarking process—from filing to prosecution of your mark.
A business’s trademark distinguishes it from other businesses and is proprietary—the primary goal of trademarking is to protect your business’s unique name or logo from being confused in commerce, or from someone else using it without your permission. After all, the uniqueness and popularity of your brand and logo should be protected at the highest level. It is also vitally important to make sure you are not infringing on another party’s trademark before using a business name or logo in commerce. We have dealt with several very unfortunate and expensive matters related to an individual’s inadvertent use of a registered mark. Kyla Wilder McGee is a high-energy, self-motivated attorney with unique professional and practical experience in business and corporate law, employment law, including negotiating and drafting employment and noncompete agreements, trademarking, and construction law. She is passionate about representing her clients. Kyla spent her elementary school years in Dubai, United Arab Emirates. As an ex-pat kid, she had the opportunity to travel the world and learn about various world cultures. She also lived abroad in Prague while in law school—traveling and exploring are both passions. In middle school, her family relocated to The Woodlands, Texas where she attended The John Cooper School. Kyla went on to attend Texas A&M University (whoop) and received her bachelor’s degree in 2008. After college, Kyla attended South Texas College of Law and has been licensed to practice since 2013. After working at a couple various-sized firms, she decided to start her own practice in 2016 out of her house. Eventually, the practice grew in size, with both clients and employees, and Wilder McGee, P.C. relocated to their new office home on Oak Ridge Drive. Kyla will give an office tour to anyone willing to take it – she is proud of the zen-style space she created to make a sometimes-stressful environment seem comforting and inviting.
Kyla is married to Jacob, they reside in The Woodlands, and have a precious four-year old daughter, Stella. The John Cooper School dragon tradition will continue as Stella will be starting her Cooper journey in 2022. If you find yourself visiting Kyla’s office, you may get the opportunity to meet her beloved Wheaten Terrier, Frankie. He comes to the office with her daily. If you speak to her clients, you will learn that Kyla is a very passionate and caring attorney and always has her client’s best interests at heart. She zealously advocates for her clients in and out of the courtroom and will always take the extra steps necessary to ensure her clients are taken care of. Last, but certainly not least, one of Kyla’s proudest accomplishments is being on the Board of the Montgomery County Women’s Center. She describes her experience with the Center as the most rewarding and humbling work of her life.
In 2023, Kristen joined Kyla as a partner with the firm. Kristen’s practice focuses on providing practical, targeted legal guidance to individuals, businesses, entrepreneurs, and non-profit associations relative to real estate, general business and civil litigation matters. Throughout her practice, Kristen has built a reputation for zealously advocating for her clients and providing well-reasoned solutions to complex legal issues. Kristen is a certified mediator which allows her to offer private mediation services and serve as a volunteer mediator with the Montgomery County Dispute Resolution Center.
Prior to her current role, Kristen practiced at a mid-size firm in downtown Houston where she represented consumer and commercial financial creditors in varying collection matters from civil litigation to bankruptcy to foreclosure to contested probate. In 2017, Kristen moved to The Woodlands where she expanded her practice to representing businesses and individuals in all areas of civil litigation, real estate, and general business law. Over the course of her career, Kristen has regularly represented individuals, entrepreneurs, businesses of all sizes, mortgage companies, banks, credit unions and property owners associations. Kristen has practiced in all counties throughout the state of Texas and all four federal district courts. She has won favorable results for her clients in civil trials and private arbitrations with results ranging from injunctive relief to equitable title to real estate to seven-figure monetary awards.
Kristen is a proud Texas native. She graduated from Texas A&M University in 2007 where she graduated magna cum laude with a degree in Communication. She received her juris doctorate from the University of Houston Law Center in 2010, where she was a member of the Journal of Consumer Law and participated on the Moot Court Team. In addition to her practice, Kristen devotes her time and energy to numerous community organizations. She sits on the Board of Directors for Montgomery County Youth Services – Yes to Youth, the Executive Women’s Alliance and the Woodlands Bar Association. She is actively involved with the Montgomery County Bar Association, The Woodlands Chamber of Commerce and the Conroe/Lake Conroe Chamber of Commerce. She is a 2020 graduate of Leadership Montgomery County and a 2013 graduate of the Houston Young Lawyer’s Association Leadership Academy.
Jennifer Hill is a highly qualified, resourceful, and incredibly creative attorney. If you have worked with her, you will realize her value immediately. Jennifer Hill received her undergraduate degree from Stephen F. Austin State University in 2008 and graduated with her J.D. from Texas Tech School of Law in 2012. She has spent over a decade working in litigation and zealously advocating for clients. She continues to use that experience and approach in representing transactional clients.
After law school Jennifer worked as a criminal prosecutor and as Child Protective Services attorney in Montgomery County, Texas, increasing her experience in both civil and criminal law. Jennifer continued her work as felony prosecutor at the Harris County District Attorney’s Office in the Special Victims Unit specializing in child sexual abuse cases. She has prosecuted over 40 trials during her career and worked on thousands of cases that were resolved without trial.
At Wilder McGee, P.C. Jennifer works with clients on business and trademarking cases to make sure that every day they receive the representation they deserve. Her attention to detail and ability to navigate through some of the toughest disputes set her apart from other attorneys. Jennifer resides in Montgomery County with her husband Tyler, eight-month-old son, Sawyer, and precious pup, Dallas.
Lisa G. Prado is a professional paralegal with over 25 years of experience in litigation, transactional, probate, and estate planning work. Lisa’s positivity and joy are absolutely contagious. She is passionate about helping her team and clients succeed, no matter what it takes. She is not afraid to roll her sleeves up and put in the hard work to get the job done promptly and thoroughly, all with a smile on her face. She has strong attention to detail, a willingness to learn, and innate desire to be an impactful team member. In her current role, Lisa is the firm’s senior paralegal and assists Kyla Wilder McGee, Rachel Sechelski, and Jennifer Hill as needed in handling the firm’s legal matters.
Lisa is originally from Corpus Christi, Texas where she attended Del Mar College while working for a mid-size law firm. It was her first job at a personal injury firm where she gained an extensive amount of litigation experience. Through her dedication and loyalty, Lisa expanded her knowledge and experience and began offering assistance to attorneys in other practice areas such as corporate litigation and arbitration, residential and commercial real estate, homeowners association litigation and compliance, estate planning and probate, and various other civil litigation matters.
Lisa is fiercely dedicated to her community and currently serves as a committee member for The Woodlands Chamber of Commerce Economic Outlook Conference Committee, the Montgomery County Food Bank Gala committee, The United Way Women Who Rock Committee, and Conroe Lake Conroe Chamber Athena Committee. Lisa was also a part of the Leadership Montgomery County (LMC) graduating class of 2022.
Lisa and her husband have lived in Magnolia, Texas for 20 years. The Prado family makes the trip south to Corpus Christi to visit family and connect to hometown roots as often as they can. Lisa and her husband have a 10-year old son, Maddox, who enjoys playing basketball, and loves art and music. Lisa is an avid reader and shopping enthusiast — there is not a shopping trip that she will turn down.
Brittney received her Bachelor’s degree from University of Houston in 2020 and takes great pride in keeping the firm organized and running smoothly. Brittney handles the firm’s engagement paperwork, assists with monthly invoicing, and is the kind and positive voice you will hear when you call our office. She enjoys spending time in nature with her daughter.
Frankie is a soft-coated Wheaten Terrier and spends his days taking care of his girls at Wilder McGee, P.C. If you have visited our office, you likely have received his lovable and unforgettable greeting. He tries really hard to be a good boy and takes his job protecting the office very seriously.
